If parents can't agree on a custody arrangement for their children, the court will decide it for them. When the court makes a decision concenrning custody in Maryland, it weighs a series of factors, which include fitness of the parents, their character and reputation, the potential to maintain natural family relations, the suitability of the parents' residences, material opportunities for the child, the child's relationship with each parent, potential disruption to the child's life, and the child's preference (if the child is old enough). The bottom line is that the court will award custody in what the judge believes to be the best interests of the child.
