Questions You Want Answered > Property Division in Divorce > What is martial property?
In Maryland, marital property is all property acquired or augmented during the marriage for which the source of the funds therefor is not an inheritance, pre-marital funds, or a gift from a third party. In other words, if it was bought during the marriage, and the money used to purchase it was earnings or savings of one of the spouses acquired during the marriage, it's marital. Maryland is a source of the funds, not a title, state. Some non-marital property can have a marital portion, as well.
