Questions You Want Answered > What is the Court Process? > What is the difference between a contested and an uncontested divorce?
An uncontested divorce is a divorce in which all of the issues concerning grounds for divorce, child custody, spousal and child support, property division and equitable distribution of assets have been resolved, and there is nothing for the court to do but grant a divorce after a short hearing. A contested divorce is a divorce in which there are some issues which the court needs to decide.
